Do godparents have rights?

Godparents hold a special place in many families, but you might wonder if they have any legal rights. Unlike parents or legal guardians, godparents usually don’t have automatic legal standing. Their role tends to be more symbolic or spiritual, often tied to religious or cultural traditions rather than legal authority.

What is the role of godparents?

Godparents usually support a child’s upbringing, often with a focus on moral or religious guidance. Families may select godparents to create a lasting bond with the child and to offer additional emotional support. However, this role does not automatically grant legal decision-making power regarding the child’s welfare.

Do godparents have custody or visitation rights?

In Illinois, godparents do not have custody or visitation rights by default. Courts prioritize biological or legal parents when deciding custody matters. If a godparent wants custody or visitation, they must petition the court and show that such an arrangement benefits the child. The court examines factors like the child’s best interests and the nature of the relationship with the godparent.

Can godparents become legal guardians?
